Two-Decisions Find Israel's Security Wall Violates Rights of Palestinians

Interview with John Quigley, professor of law at Ohio State University conducted by Melinda Tuhus

Two recent court rulings have declared illegal at least some portions of the 425-mile security barrier Israel is building, one-quarter of which is finished. Israeli Prime Minister Ariel Sharon says the barrier is necessary to protect Israelis from Palestinian attacks. But Palestinians say it is a land grab, since most of the barrier is being built on the Palestinian side of the border, and in many parts well inside Palestinian territory.

On June 30th, Israel's Supreme Court ruled that 20 miles of the barrier must be rerouted because that segment violates the human rights of Palestinians, even if Israeli security is compromised by the changes. The court said that while Israel has a right to build a wall, the route chosen "severely violated" freedom of movement and "severely impaired" the livelihood of locals, leaving villages in a "virtual chokehold."

On July 23th, the International Court of Justice issued an advisory opinion that construction of the wall violated international law. It ruled that Israel must stop construction and dismantle parts already built in occupied Palestinian territory, including areas in and around East Jerusalem. The advisory opinion has been sent for consideration to the United Nations General Assembly, which has historically upheld the rights of Palestinians. Between The Lines' Melinda Tuhus spoke with John Quigley, professor of law at Ohio State University and author of the book, "Palestine and Israel: A Challenge to Justice." He describes the impact these court decisions may have on public opinion in the Middle East and on Washington's historic support for Israeli security policy.

John Quigley's book, "Palestine and Israel: A Challenge to Justice," is published by Duke University Press.

Put it on the Green Line
by ANGEL Monday, Jul. 19, 2004 at 12:54 AM

If Israel wants a wall they should build it on the Green Line (pre 1967 borders)
Why do we have to have total dismantling of the settlements to have peace?
Since there are some 1,200,000 or so Arabs living inside the pre 1967 Israeli borders, and maybe around 400,000 Jews living in the West Bank and Gaza.
Why not just have Israel exist in it pre 1967 borders with a majority Jewish Population and a minority Arab Population, as long as the minority Population had all the same rights as the Majority.
Then you can have the Palestinian State inside the West Bank and Gaza with a Majority Palestinian Population and a Jewish minority.
Once you have these two State and the two States are at Peace instead of this never ending conflict for Palestinian Freedom. The Jews who do not like living in Palestine can choose of their own free will to move into Israel.
And the Arabs who want to Move to Palestine, once it is a Free Country without the Israeli Military Presence, can choose to move there of their own free will.
This would sure be better then trying to dismantle all the settlements.

" Why not just have Israel exist in it pre 1967 borders "

Those borders were indefinsible...that's why the Arabs attacked on 5 separate occasion in an attempt to anihilate israel...Since israel wond the miraculous Six Day War, the Arabs who were the main attackers (Jordan and Egypt) have signed peace agreements...

Since I will not honestly or ethically or willingly provide an official list of the names I irrationally and immaturely deem is mine and mine alone, names which are not legally registered and sanctioned by any officially recognized body, I hereby affirm and concede I am universally understood to be stupid beyond measure, and have no claims. Freedom for the Palestinian equal Peace for Israel
by ANGEL Monday, Aug. 02, 2004 at 3:41 AM

I am not the only person on earth with the name ANGEL......
How many MIKE's are there?
Tit for Tat is getting us nowhere, as proof you can see there is still conflict after thirty six years. So you have to look at the problem as it stands today, and do the right thing so both people can live in peace and with freedom.
If only one side has freedom, the other side will always be seeking it, in anyway they can. That is why there have been wars as far back as we can remember.
Thirty six years of war should be enough for such a small number of people, when you consider the World Population.
You can save Israel by allowing the Palestinian People to have their small state in the Whole of the West Bank and Gaza.
There are 1,200,000 or so Arabs living inside Israel Proper.
There are 400,000 or so Jews living inside the West Bank and Gaza.
Trying to remove all the settlement can be an almost undoable task.
So Set the Borders for Israel to it Pre 1967 Border (Green Line) and have the State of Palestine inside the West Bank and Gaza.
If the U.N. can decide the Borders of Israel in 1948.
The U.N. can decide the Borders of Palestine in 2004.
You would end up with Israel with a majority Jewish Population and Palestine with a majority Muslim Population.
This would allow for the Israeli Military to Guard and Control the Israeli pre 1967 borders instead of confiscating Palestinian Land and Demolishing Palestinian Homes in the West Bank and Gaza that only goes to fuel the need for the Palestinian People to fight for their Freedom.
The Jews who do not like living in the new Palestinian State can feel free to move to Israel if they so choose.
The Arabs living inside Israel can feel free to move to the new Palestinian State if they so choose.
Almost every nation on earth has more then one ethnic group or religious group. So why not Israel and Palestine?
It would sure be better then the never ending conflict we have right now.

Quit using our imaginations
by anyman Wednesday, Aug. 04, 2004 at 9:13 AM

There will be no peace anywhere until capitalism, nationalism, and monotheism are put into dry dock.

As long as we pretend that colored pieces of paper are worth our lives, pretend that there are such thing as imaginary lines on maps, and that ghosts in the sky want us to kill each other, we're all up shit creek.

Imagine theirs no Heaven
by John Lennon Thursday, Aug. 05, 2004 at 8:30 AM

Imagine theirs no Heaven, no Religion too.
What we all have to evolve to, to end cause because of religion.
That might take another 2000 years, if we still have a planet.

Imagine theirs no Heaven, no Religion too.
What we all have to evolve to, If we are to stop the wars connected to religion.
It may take another 2000 years if we still have a planet left, and if we do have a planet left, if there are still humans left, and we did not destroy each other through war.

Waz up,Z?
by TheTroll Monday, Sep. 06, 2004 at 8:06 PM

Nazis once built a wall along the French coast. Was that wall defensive, like the ZIonist crusaders say about the wall they are building? Or, was it just a defensive tactic in the Nazi's offensive occupation of France.

Outside of Zionist occupied Palestinian and Syrian lands, there is NO "Israel." And just because the Judeo-christian dominated 1947 UN appeased the ZIonist's bloodsoaked crusade doesn't mean the ZIonists are not murderous thieves. It just means that todays Judeo-christian power brokers are not too different than those who appeased and supported the judeo-christian crusades.
